DCV- LEED ENERGY MODELING

If design case has Demand Control Ventilation required by code or not required by code. In both the cases can we model with DCV in baseline. so that i can show identical ventilation for both design and base case .( not taking credit for DCV) 

Please advice.

If it is required by code, then you must run it in the baseline.

If it is not required by code, then you can skip it in the baseline. However, if you modeled it in the baseline as well, I don't think they could really flag you for that - because it would likely lower your LEED points.

If DCV is not required by code then the baseline must be run using 62.1 Ventilation in the baseline and the ventilation rates between proposed and baseline do not have to match.  Its in 90.1-2007 G3.1.2.5, exception.
